1. About These Terms

These Terms of Use (the "Terms") are a legal agreement between you and Oxixo Private Limited, a company registered in Singapore ("Oxixo", "we", "us" or "our"). They apply when you use ThaiFriendly, including our websites, our iOS and Android apps, and any related features or services (together, the "Service"). Oxixo also operates other dating services, such as ThaiFriendly, PinaLove and VietnameseLove; when these Terms say "our services", they mean all of them.

By creating an account, or by using the Service without an account, you agree to these Terms. If you do not agree, do not use the Service.

The following documents are part of these Terms, and you agree to them too:

Our Privacy Policy explains how we collect and use your personal data. Please read it, together with our Dating Safety tips.

If these Terms and another of these documents conflict, these Terms apply, except that the Privacy Policy decides how we handle personal data.

Parts of these Terms about apps, purchases and paid features apply only where ThaiFriendly offers them.

2. Who Can Use ThaiFriendly

ThaiFriendly is for adults only. To create an account or use the Service, you must:

  • be at least 18 years old and legally able to enter into this agreement;
  • not be barred from using the Service by the law where you live;
  • never have been convicted of a sexual offence, an offence involving a child, or a serious violent offence (such as violence against a partner), and not be required to register as a sex offender anywhere. A conviction that is treated as spent or removed from your record under the law where you live does not count; and
  • not be banned from ThaiFriendly, or from all our services because of child safety, violence or similar serious harm, unless we have told you in writing that you may return.

Some countries set a higher age at which you can make contracts or purchases without a parent's or guardian's consent. If you are under that age where you live, you must have that consent before you use the Service or make a purchase. Consent never allows anyone under 18 to use the Service.

We check members' ages using the information they give us, such as their date of birth, and automated estimates of age from their photos. We may also ask you to complete face verification. We will close the account of anyone we believe is under 18. The Privacy Policy explains what we keep afterwards to stop that person from rejoining before they turn 18.

3. Your Account

One person, one account. Each account must belong to one real person. You may have only one account on each of our services. You may not share an account with anyone else, for example as a couple, and you may not run an account for someone else. Do not create another account to get around a restriction, a block by another member, or a ban.

Be honest about who you are. Your profile must describe you. Your age must be your real age, and your photos must be real, recent photos of you. You may use a nickname instead of your real name, and the Privacy Policy explains how to protect your privacy without misleading anyone. You may not pretend to be someone else, or use photos of another person, AI-generated photos of a person, or photos edited so heavily that they no longer look like you.

Keep your account secure. You are responsible for what you do with your account and for anything you allow someone else to do with it. Keep your login details private, and do not let anyone else use your account. If you think someone has accessed your account without permission, contact us immediately.

Your account is personal. You may not sell, rent, give away or transfer your account, your username, your Premium membership or your credits.

Verification. We may ask you to complete face verification before you can use some features, or to keep using your account. Until you complete it, we may limit your account. Face verification is explained in the Privacy Policy.

4. Safety and Other Members

We work hard to keep ThaiFriendly safe. Moderators and automated systems review accounts, photos and activity, and we verify members' faces. But we cannot know everything about every member, and we do not carry out criminal record or background checks. A "verified" badge means only that the member's face matched their profile photos when they verified. It does not tell you their real name, their intentions, or whether they are safe to meet.

ThaiFriendly is not a marriage agency, an introduction agency or a matchmaking service. We do not recommend, introduce or vouch for any member. You decide who you talk to and who you meet, and you are responsible for those decisions.

Please follow our Dating Safety tips, in particular:

  • Never send money, gifts, cryptocurrency, gift cards, bank details or copies of your ID to someone you met on ThaiFriendly, whatever reason they give. Requests for money are the most common sign of a scam.
  • Get to know someone before you meet. Meet in a busy public place, arrange your own transport, and tell a friend where you are going.
  • Report anyone who asks you for money, makes you uncomfortable or breaks our rules. Reporting protects other members too.

You are responsible for how you treat other members, on the Service and off it. We are not responsible for what other members say or do, but we act on reports, and we may take action under these Terms when a member harms or endangers someone, including outside the Service.

5. Rules You Must Follow

You must follow our Community Guidelines and the law. In particular, you must not use the Service to:

  • harm or sexualise children. This includes anything described in our Child Safety Standards, such as seeking contact with anyone under 18, sexual talk about children, sharing images of children, or being under 18 yourself;
  • buy or sell sex. This includes offering or asking for sex, sexual services, paid video calls or adult content in exchange for money, gifts or any other benefit, or advertising them here or elsewhere;
  • ask for money or financial help. This includes begging; asking for money, gifts, loans, payments, gift cards or cryptocurrency; and any story designed to get money from another member, such as a medical emergency, travel costs or a family crisis;
  • scam or defraud anyone. This includes romance scams, investment or cryptocurrency schemes, fake job offers, and stealing or using another person's payment details;
  • create a false identity. This includes fake profiles; pretending to be another person; using someone else's photos; AI-generated photos of a person; lying about your age; and creating more accounts than you are allowed;
  • harass, threaten or abuse anyone. This includes hate speech; threats of violence; stalking; blackmail; and repeated unwanted contact, especially after someone has said no or blocked you, including through new accounts;
  • share private or intimate material without consent. This includes another person's personal information and any intimate image of anyone without their consent. Threatening to share such material is also forbidden;
  • post sexual or violent content that our Community Guidelines do not allow, or send sexual images to anyone who has not clearly asked for them;
  • advertise or do business. This includes promoting products, services, websites or events; recruiting members for work or for agencies, including adult content (such as OnlyFans), webcam work, bars, karaoke, massage or modelling; and offering visa, marriage or relocation services;
  • send spam or the same or similar messages to many members;
  • buy, sell or promote illegal drugs, weapons or other illegal goods or services, or take part in human trafficking or any other crime;
  • misuse the Service or our systems. This includes using bots, scripts, scrapers or other automated tools; collecting other members' information; copying the Service or its content; getting around our limits, verification or security; reverse engineering our apps; or doing anything that interferes with the Service.

These rules also cover trying to do any of these things, and getting someone else to do them for you. They apply when you move a conversation from ThaiFriendly to another app to ask for money or to sell sex. Sexual material involving children is forbidden in every form, including drawings and AI-generated images.

You may exchange contact details with another member in private messages if you both want to. Do not put contact details or social media handles in your public profile.

6. Your Content

"Your content" means everything you add to the Service: profile text, photos, videos, voice recordings, posts and messages.

You own your content. You keep any rights you already have in your content. To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example resize, crop, compress or transcribe), display and share your content as needed to provide, moderate, protect and improve the Service. This includes showing your profile to visitors and other members, according to your visibility settings and the Privacy Policy. You also allow other members to view the content you share with them, through the Service.

This licence ends when you delete the content or your account, except:

  • copies we keep as described in the Privacy Policy, for example after a ban or for legal reasons; and
  • messages and media you sent to other members, which stay in their conversations until they are deleted.

We will not use your photos in third-party advertising, such as ads on other websites or apps, without your permission.

Your promises about your content. You promise that you have the right to share your content, and that it follows these Terms and the law.

Content we remove. We may remove or restrict any content that we reasonably believe breaks these Terms, breaks the law or puts someone at risk.

Automatic deletion. Some content is deleted automatically after a set time, as explained in the Privacy Policy. For example, photos and videos sent in chat are deleted after a few days, and messages after one year. We may not be able to restore content that you or these automatic deletion rules have removed, so keep your own copy of anything you want to keep. Our data download tool can help.

Feedback. If you send us ideas or suggestions, we may use them freely, without owing you anything.

7. How We Moderate

To keep members safe and enforce these Terms, we review profiles, photos, videos, voice recordings, posts and messages. This includes private messages and media. We use human moderators and automated tools, including AI and face analysis. We review content when members report it, and our automated systems also check content and activity to detect problems such as scams, requests for money, selling sex, drugs, fake profiles, people under 18 and banned members returning. Automated tools can flag a case and can take some actions on their own, and our team reviews serious cases. The Privacy Policy explains how this uses your data.

If we reasonably believe you have broken these Terms or the law, or are putting someone at risk, we may:

  • remove or hide content;
  • show your profile to fewer members, or limit who receives your messages;
  • limit features, such as messaging or uploading photos;
  • require you to complete verification;
  • temporarily suspend your account;
  • permanently close (ban) your account;
  • close other accounts we reasonably believe belong to the same person, and block that person from returning;
  • keep evidence and report the matter to the police or other authorities.

We decide what to do in each case. We consider how serious the breach is, whether it has happened before, your history on ThaiFriendly and the risk to other members. A minor breach may lead to a warning or a temporary suspension. A serious breach can lead to a permanent ban the first time, and so can repeated breaches. In urgent cases we may act before we have finished reviewing.

If a ban is for child safety, violence or similar serious harm, it may apply to all our services, not just ThaiFriendly.

When we restrict or close your account, we will normally tell you why, in general terms. We will not tell you anything that would reveal another member's identity, help someone get around our safety systems, or break the law. Where the law allows, we may not tell you at all, for example when telling you would warn someone involved in fraud.

8. Reports and Appeals

Reporting. You can report a member, a profile, a photo or a message from inside the app or website. You can also contact our support team. Anyone, including people who are not members, can report child safety concerns to childsafety@oxixo.com. If someone is in immediate danger, contact the police first. We review reports and decide what to do under these Terms. We may not always tell you what we decided, to protect other members' privacy.

Reporting illegal content. If you believe something on the Service is illegal, report it and tell us:

  • where it is, for example the username;
  • why you believe it is illegal; and
  • how we can contact you.

Appeals. If we have closed your account and you believe we made a mistake, you can ask us to review the decision using the link in the notice we show you or our review request page, where these are offered, or by contacting our support team. A member of our team will review your request, and we will tell you the result by email. We usually answer within a few days. Short suspensions end automatically. If you think one was a mistake, contact our support team.

Once we have confirmed that an account belonged to someone under 18, or that it harmed or endangered a child, we do not restore it. If you believe we have the wrong person or the wrong facts, you can still ask us to check.

9. Premium and Purchases

Basic use of ThaiFriendly is free. We also sell optional paid features: Premium membership, and credits that you can spend on features such as Boosts. We show what each purchase includes, its price and, for subscriptions, how often you will be charged, before you buy.

How you pay. Most purchases are made in our apps through the Apple App Store or Google Play, and the store takes the payment. The store's own terms and payment rules also apply to those purchases. On our websites we may also offer Premium for a fixed period through other payment methods. Those are one-time payments that do not renew automatically, and we handle their refunds ourselves. We do not take card payments on our websites.

Automatic renewal. Premium bought through an app store is a subscription. It renews automatically for the same length of time, at the renewal price shown when you bought it (or a new price we have told you about, as explained below), until you cancel. For Apple, cancel at least 24 hours before the current period ends to avoid being charged for the next one. For Google Play, follow the cancellation deadline Google shows you.

Cancelling. You can cancel at any time in your Apple ID or Google Play subscription settings. Cancelling stops future renewals. Premium continues until the end of the period you have already paid for. Deleting the app or your account does not cancel your subscription. You must cancel it with the store. One-time payments made on our websites do not renew, so there is nothing to cancel; that Premium ends when the period you paid for ends.

Free trials and introductory offers. If we offer a free trial or introductory price for an app store subscription, we will show its terms before you start. Unless you cancel before the trial or offer ends, it becomes a paid subscription at the normal price. Trials and offers are limited to one per person, and we may decide who is eligible. For example, a member who has paid before, or whose other account already used an offer, may not be eligible.

Price changes. We may change our prices. A price change for an existing subscription applies only from a future renewal, after the notice the app store requires. You can cancel before it takes effect.

Premium belongs to you. Premium is personal and cannot be transferred to another person. If we recognise another account on the same service as yours, your remaining Premium may move to it automatically. This does not allow you to have more than one account or to return after a ban.

No guaranteed results. Premium features, such as appearing higher in search, help you get noticed. They do not guarantee matches, messages, replies or dates.

Changes to paid features. We may change features for legal, security or technical reasons, or to improve the Service. If we significantly reduce or stop providing a paid feature for any reason other than your breach of these Terms, we will give you reasonable notice where we can. You may then end the affected purchase and get a refund for unused prepaid time and unused credits; if you agree, we can give you Premium time or credits instead.

10. Credits and Boosts

Credits (called Mangos on ThaiFriendly and Pineapples on PinaLove) are virtual credits for use on ThaiFriendly only. When you buy them, you get a personal right to spend them on features in the Service. They are not money and have no cash value. You cannot exchange them for money, transfer them, or use them on our other services.

While your account is open, credits do not expire. You lose any unused credits when your account is deleted or closed under these Terms.

A Boost shows your profile to more members for a set amount of time, which runs only while you are online. Its price and length are shown before you use it. It increases how often you are seen, but it does not guarantee views, likes or messages.

If a purchase of credits is refunded, we remove that number of credits from your balance.

11. Refunds

Our Refund Policy explains when you can get a refund. Refunds for purchases made through the Apple App Store are handled only by Apple; we cannot issue them. To ask for one, go to reportaproblem.apple.com. Refunds for purchases made through Google Play can be handled by us or by Google. Refunds for payments made on our websites are handled by us.

Our Refund Policy gives first-time paying members a 14-day money-back guarantee, which can be used once. It does not apply to purchases made through the Apple App Store, or to accounts we close for breaking these Terms.

Apart from the Refund Policy and these Terms, payments are not refundable, including for unused Premium time and unused credits. We may still choose to give a refund in a particular case. None of this affects any right to a refund or to cancel a purchase that you have under the law where you live.

If the law requires us to refund a purchase that the store cannot refund, we will pay you another way, for example directly. We will only give you Premium time or credits instead of money if you agree.

12. Closing or Losing Your Account

You can leave at any time. In your account settings you can:

  • turn off your profile, which hides it until you turn it back on;
  • reset your account; or
  • delete your account.

The Privacy Policy explains what each option removes and when. Remember to cancel any subscription with the app store as well.

We can close or suspend your account if:

  • you break these Terms;
  • we reasonably believe your account puts members, us or anyone else at risk;
  • we are required to by law; or
  • your account has been inactive for a long time, as explained in the Privacy Policy. We may email you before we delete an inactive account, but we cannot if you have unsubscribed from our emails.

We can also stop offering the Service. If we do, we will give you reasonable notice, and we will refund unused prepaid time and unused credits as explained in section 9.

If we suspend or close your account for breaking these Terms:

  • you are not entitled to a refund for Premium, credits or any other paid feature, unless a mandatory law where you live requires one. We may still choose to give one, as explained in section 11. A suspension does not extend your Premium. If we close your account, you lose access to it, to your Premium membership and to your credits;
  • you must cancel any subscription with the app store yourself, because closing your account may not cancel it. The notice we show you explains how;
  • you may not create a new account on ThaiFriendly, or on any of our services when the ban applies to all of them, unless we tell you in writing that you may. We may close any new account you create.

Sections 6 (the parts about content already shared), 11 and 15 to 23 continue to apply after your account is closed.

13. Your Privacy and Data

Our Privacy Policy explains what personal data we collect, how we use and share it, how long we keep it and what your rights are. This includes:

  • face verification and other face data;
  • moderation of messages and media;
  • the records we keep after a ban; and
  • how to download or delete your data.

We protect your data with reasonable security measures. No online service is completely secure, though, so please follow the security tips in the Privacy Policy.

We keep and share personal data only as described in the Privacy Policy and as the law allows. For example, we may share it with the police or other authorities to comply with a lawful request, or when we believe it is needed to prevent imminent harm.

14. Our Service and Apps

The Service belongs to Oxixo and its licensors, including its design, software, text, graphics and the ThaiFriendly name and logo. Members' content belongs to its owners. Apart from the rights these Terms give you, you have no right to use any of it.

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use our apps on devices you own or control, and to use our websites, only to use the Service as these Terms allow. You may not copy, change, sell or distribute our apps or content, create other apps or services based on them, or use our name or logo without our written permission. The licence ends when your account is closed or when you stop using the Service.

We work to keep the Service available and working well. But it may sometimes be unavailable, for example during maintenance, updates or problems outside our control, and we may change or stop features at any time.

The Service may include features or content from other companies, for example GIFs or sign-in with Apple or Google. Those companies' own terms may also apply, and we are not responsible for their services.

15. Apple and Google

If you downloaded our app from the Apple App Store, you and Oxixo agree that:

  • these Terms are between you and Oxixo only, not Apple, and Oxixo, not Apple, is responsible for the app and its content;
  • your licence to use the app is limited to Apple-branded devices you own or control, as Apple's Usage Rules allow, including any Family Sharing or volume purchasing those rules permit. This never allows anyone else to use your ThaiFriendly account;
  • Oxixo alone is responsible for any maintenance and support of the app that these Terms promise or the law requires. Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to meet any warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app. Oxixo is responsible for any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty, to the extent these Terms do not validly exclude them;
  • Oxixo, not Apple, is responsible for dealing with any claims by you or anyone else about the app or your possession or use of it, including:
    • product liability claims;
    • claims that the app does not meet legal or regulatory requirements; and
    • consumer protection, privacy or similar claims;
  • if anyone claims that the app or your possession or use of it infringes their intellectual property rights, Oxixo, not Apple, is solely responsible for investigating, defending, settling and resolving that claim;
  • you confirm that you are not located in a country that is subject to a US government embargo or that the US government has designated as "terrorist supporting", and that you are not on any US government list of prohibited or restricted parties;
  • you must follow any third-party terms that apply when you use the app, for example your mobile network's terms; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

Questions, complaints and claims about the app should be sent to us using the details in Contact Us.

If you downloaded our app from Google Play, Google's terms for Google Play also apply. Google is not responsible for the Service.

17. Disclaimers

We provide the Service "as is" and "as available". As far as the law allows, we make no promises about the Service other than those set out in these Terms. We do not promise:

  • that the Service will always be available, secure or free of errors;
  • that you will find a match or a relationship;
  • that information members give about themselves is true; or
  • that any member is who they say they are or is safe to meet.

As far as the law allows, we are not responsible for the conduct of any member or other person, on the Service or off it. Nothing in this section excludes our responsibility for our own breach of these Terms, our negligence or our duties under the law, subject to the limits in section 18.

Some countries do not allow certain warranties or rights to be excluded. Nothing in these Terms removes any right you have under consumer law that cannot be excluded by contract.

18. Limits on Our Liability

As far as the law allows:

  • we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of profits, data, goodwill or opportunity, arising out of or in connection with the Service or these Terms; and
  • our total liability to you for all claims arising out of or in connection with the Service or these Terms will not be more than the greater of (a) 100 US dollars and (b) the total amount you paid for the Service, including payments made through an app store, in the 24 months before the event that gave rise to the claim.

These limits apply however the claim arises, including claims about the conduct of other members.

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • anything else that the law where you live does not allow us to limit or exclude.

19. Your Responsibility to Us

As far as the law allows, you are responsible for losses, including reasonable costs of dealing with claims by other people, that are directly caused by your deliberate or negligent breach of these Terms or by your unlawful conduct, and that we could reasonably have foreseen.

This does not cover losses caused by our own fault or that we could reasonably have avoided. If someone makes such a claim, we will tell you promptly, and we will not agree a settlement that binds you without your consent.

20. Disputes

Talk to us first. If you have a problem with the Service, please contact our support team first. Most issues can be solved quickly that way. If we cannot solve it, you agree to give us 30 days from when you first contacted us to try to resolve it before you start legal proceedings, except where the law where you live does not allow this. This does not stop either of us from seeking urgent relief from a court, starting proceedings needed to meet a legal deadline, or complaining to a regulator.

Governing law and courts. These Terms, and any dispute about them or the Service, are governed by the laws of Singapore. Subject to the next paragraph, the courts of Singapore have exclusive jurisdiction.

If you are a consumer, you still have the protection of any mandatory laws of the country where you live, and you may bring a claim in the courts of that country where its law gives you that right.

21. Extra Rights Where You Live

The law in some countries gives you rights in addition to those in these Terms, and these Terms do not take them away. In particular:

  • European Union and United Kingdom. Where the law requires it, we give reasons for our moderation decisions and let you ask a person to review them. This includes, where the EU Digital Services Act requires it, at least six months to ask for a review. Any right you have to use a certified out-of-court dispute settlement body, or to go to court, is not affected. You can contact us about these matters through our support page, in English or the language of your country.
    Any legal right you have to cancel a purchase within 14 days comes from the law, not from the app store's rules. To use it, contact the store you bought from or our support team.
  • Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits them.

22. Changes to These Terms

We may update these Terms, for example when we change the Service, when the law changes or to deal with new safety risks.

If a change is important, we will tell you at least 30 days before it takes effect, by email or in the app. Changes needed for legal reasons or to deal with an urgent safety risk may take effect sooner. If you keep using the Service after a change takes effect, the updated Terms apply to you.

If you do not agree to a change, you can delete your account and cancel any subscription before the change takes effect. If the change significantly reduces what you have already paid for, section 9 explains your refund.

The date at the bottom of this page shows when these Terms were last updated.

23. General

  • Whole agreement. These Terms, together with the documents listed in section 1, are the whole agreement between you and us about the Service.
  • If part is invalid. If a court finds any part of these Terms invalid or unenforceable, that part does not apply, and the rest of the Terms continue to apply as far as the law allows. An invalid term will not be replaced by one that is worse for you as a consumer.
  • No waiver. If we do not enforce a part of these Terms straight away, we can still enforce it later.
  • Transfer. You may not transfer your rights under these Terms. We may transfer ours, for example if our business is sold or reorganised, as long as your rights are not reduced.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
  • Notices. We may send you notices by email, in the app or on the Service. You can send notices to us through our support page or by post to the address below.
  • Translations. If we provide these Terms in another language, the English version applies if the versions differ, unless the law where you live requires otherwise.
  • No other beneficiaries. Apart from Apple as described in section 15, no one else has rights under these Terms.
